What this document is
This is the appellate court’s decision reviewing the trial court’s summary judgment in favor of The Wharf at Clear Lake Slip Maintenance Association, Inc. on Eric Springstun’s counterclaims.
Disposition
The Ninth Court of Appeals affirmed the trial court’s judgment.
Background the opinion records
The opinion recounts that the Association filed the original injunction action in July 2023, that the litigation involved disputes arising from Eric Springstun’s prior board service and later events, and that the case eventually proceeded to summary judgment on Springstun’s counterclaims after the Association had nonsuited its own affirmative claims.
Summary-judgment reasoning
The appellate opinion explains that, in responding to the no-evidence summary-judgment motion, Eric Springstun did not submit affidavits or other summary-judgment evidence sufficient to create a genuine issue of material fact on the challenged claims. The court therefore affirmed the judgment.
Why the full chronology matters
The opinion reviews the later summary judgment on Eric Springstun’s counterclaims, but it should not be read as though the Association’s original affirmative claims had prevailed. The Association filed the case, did not obtain the requested temporary injunction after hearing, and later voluntarily nonsuited its own affirmative claims. Springstun’s counterclaims then proceeded through a separate summary-judgment record and appeal.
Preserving that sequence prevents a later appellate affirmance on the counterclaims from being misread as a blanket victory for every position the Association originally asserted when it filed suit.
